Thomas Jay Hall & Robert Axel Kasuba - Court Tosses Out Communities’ Land Use Regs in Favor of Developer
This November 17, 2005 Globe St.com article entitled "Court Tosses Out Communities’ Land Use Regs in Favor of Developer" discusses a recent land use ruling with wide implications in NJ. Thomas Hall, a Member of the Firm, and Robert Kasuba, an associate of the Firm, represented a development company proposing construction of 700 units of market rate housing and 140 housing units for low and moderate income households alongside the Hackensack River. The Superior Court of New Jersey has struck down land use regulations of the towns of Carlstadt and East Rutherford, as well as those of the New Jersey Meadowlands Commission, a state agency, paving the way for the proposed development. Judge Jonathan N. Harris ruled that the two communities “have engaged in patterns of exclusionary zoning that violate the New Jersey Constitution as interpreted in the Mount Laurel cases, their progeny and the Fair Housing Act of New Jersey.” To read this entire article, please click on the following link.
