Kevin Moore is quoted in this article regarding the New Jersey Supreme Court's unanimous decision ruling that cities and towns have to prove a site is truly "blighted" before invoking eminent domain, and not simply "underutilized." Mr. Moore stated: "The Court's decision puts developers in a brave new world .... Developers would be well-advised to do enhanced diligence on procedural and substantive actions that a municipality took to declare an area 'in need of development' before they enter into an agreement .... The potentially most far-reaching and disturbing aspect is the Court's narrowing of the constitutional definition of blight."
